Acceptance of These Terms
These Terms of Service govern the use of the website operated by Tes Transportation Inc. and the yard services provided by the company at 15 Algonquin Forest Dr, East Gwillimbury - L9N 0C6, Canada (CA). By using the website, submitting the contact form, booking a load, presenting a driver sheet at the window or signing a fuel advance stub, a user agrees to these terms.
A user who does not accept these terms should stop using the website and should not book work through the yard. No variation of these terms applies unless the company agrees to it in writing and signs the variation. A verbal promise made on the deck does not override these terms.
Definitions
In these terms, the company means Tes Transportation Inc. The yard means the logging haul facility at 15 Algonquin Forest Dr, East Gwillimbury - L9N 0C6, Canada (CA). The website means the pages served at testransport.hair and their linked services pages and contact page. A carrier means the business that books a load or sends a driver to the yard. A driver means the person operating a vehicle on behalf of a carrier. A ticket means the numbered booking record issued at the load board bays. A weigh bill means the record of gross, tare and net weight issued at the scale house.
A service means any of the six yard services described on the services page, namely load board bays, driver sheet runs, weigh bill desks, route check windows, tire log reviews and fuel advance sittings. A user means any person who accesses the website or deals with the yard.
The Services We Provide
The company provides dispatch support for timber hauling. The services are operational rather than advisory. The company posts loads, prepares paperwork, certifies weight, checks route clearances, reviews tire records and administers advances. The company does not act as the carrier for a move unless a separate written haulage agreement says so.
The description of each service on the website is a summary. The detailed operating rules for each desk are posted at the yard and are available from the gate office. Where the website summary and the posted yard rule differ, the posted yard rule governs, because the yard rule reflects the conditions of the facility at the time of the move.
The yard operates as a dispatch partner rather than as a broker of record for every move. Where a broker posts a load to the board, the carriers contract is with that broker, and the yard provides the paperwork and the scale record that support it. Where the company itself sources a timber move, a separate bid and acceptance exchange sets the rate and the delivery window before the ticket is opened.
Bookings and Ticket Numbers
A booking is made when a load board bay issues a ticket number against a named carrier, a described tractor and trailer pair and an agreed rate. A ticket number is unique to that load and does not transfer to a different load. A carrier who wishes to move a different load must request a new ticket.
A booking may be cancelled before the truck enters the scale house without charge. Where a truck has already been weighed and released, cancellation is treated as a failure to complete the move, and the company may charge for the scale time and the dispatched capacity that could not be re-sold.
The company may decline a booking where the tractor or trailer does not suit the posted load, where the carrier cannot show valid insurance, or where the carrier has an unsettled account at the fuel desk.
Ticket numbers are issued in sequence but are not a queue position. Two trucks may hold consecutive tickets and arrive in any order, because the deck is loaded by species and by bunk count rather than by number. A carrier should not assume that a lower ticket number guarantees an earlier scale slot during the morning peak.
Carrier Obligations
A carrier must hold valid registration, insurance and operating authority for every move it books. The carrier must provide accurate tractor and trailer identifiers at the board bay and must tell the desk if a unit changes after the ticket is issued.
- The carrier must ensure that its driver holds the appropriate licence and is fit to drive.
- The carrier must maintain the vehicle in a safe condition and must report any defect noticed at the yard before leaving with a loaded bunk.
- The carrier must follow the driver sheet, including gate codes, delivery windows and return instructions.
- The carrier must not alter a weigh bill, a driver sheet or an advance stub after it has been signed.
- The carrier must pay any advance, scale charge or agreed fee within the period stated on the ticket.
A carrier who fails to meet these obligations may have future bookings suspended until the matter is resolved. Suspension does not relieve the carrier of any amount already owed.
Driver Sheets and Instructions
The driver sheet is the operative instruction for a run. It is printed at the run window and signed by the driver before the truck leaves the fence. A verbal instruction from a clerk does not replace the sheet. If a driver believes that a verbal instruction is correct and the sheet is wrong, the driver must return to the window and have the sheet reissued rather than act on the verbal instruction.
A driver is expected to record any incident on the note field of the sheet. Incidents include a closed gate, a changed delivery window, a road closure, a load refused at the mill or a defect noticed on the road. A sheet returned without notes is treated as a report that the run proceeded as planned.
The sheet also carries the return leg instruction, which is often the part a driver remembers least. Where a return load is already booked, the ticket for that leg is printed on the back of the sheet. A driver who reaches the return mill without the sheet will be turned away at the gate and will have to call the yard for a reissue, which consumes a full scale slot.
Weigh Bills and Weight Records
Weight is certified at the scale house on the beam maintained for that purpose. The weigh bill records gross, tare and net, and the record is signed by the desk clerk. A carrier who disagrees with a weight must raise the disagreement before the load leaves the yard, while the bunk can still be re-weighed.
Where the recorded weight is later challenged, the yard ledger and the certified beam book are the authoritative records. A photograph of a screen or a verbal recollection of a reading does not override the ledger. The company will provide a copy of the ledger entry on request.
A carrier must not instruct a driver to overload a legal weight or to remove a bunk after weighing without a re-weigh. A load found to be over the recorded weight at a check station is the carriers responsibility, and the company will provide its records to any authority investigating the matter.
Seasonal variation matters on timber loads. Green wood weighs differently from seasoned wood, and a bunk that weighed within limit in spring may exceed the ticket band after a dry summer. The desk therefore reads the species and the moisture class on the ticket before it accepts a historical tare, and it will re-weigh the empty unit where the difference is material.
Route Clearance
The route check window issues a clearance stamp for a specific tractor and trailer pair against a specific corridor. The stamp is evidence that the company checked the information available to it at the time of issue. It is not a guarantee that no unexpected restriction will appear on the road.
A clearance stamp is void if either unit is swapped, if the gross weight changes, or if the corridor changes. A driver who deviates from the cleared corridor does so at the carriers risk. Where a road condition changes after the stamp is issued, the driver should contact the yard before proceeding on an uncleared route.
Clearance is also checked against seasonal restrictions. Ontario applies reduced axle limits on many municipal roads during the spring thaw, and a corridor that is clear in August may be closed to heavy timber in March. The window keeps a short calendar of known restrictions and reviews it at the start of each shift.
Fuel Advances
A fuel advance is a sum paid against a live ticket and recovered when the weigh bill settles. The advance is recorded on a stub, signed by both the carrier representative and the desk clerk, and capped against the expected net of the ticket.
No advance is issued against a ticket that has not been opened at a load board bay. No second advance is issued on the same ticket. Where a ticket is cancelled or a load is not completed, the advance becomes due immediately and may be recovered from future settlements or by invoice.
The company may decline an advance where the carrier has a history of unsettled stubs or where the ticket value does not support the requested amount. A refusal is not a penalty, and a carrier may ask the gate office to review a refusal.
Advances are deliberately modest. The desk prefers to issue a smaller amount twice rather than a large amount once, because a carrier who has not yet proven a settlement record should not carry a large exposure on a single stub. Carriers with a settled history may request a higher cap, and the gate office will review the request against the last three settled tickets.
Tire Logs and Safety
Tire log reviews are a record keeping service. The company records tread readings, rotation dates and reported damage and may recommend a repair. The company does not perform tire work unless the carrier asks for it under a separate arrangement.
A recommendation in a tire log is advice for the carrier to consider. The carrier remains responsible for the roadworthiness of its vehicle. A review that does not flag a defect does not mean that no defect exists, and a carrier must still inspect its own equipment.
The log is also useful at resale. A tractor sold from this region carries a history of the roads it worked, and a buyer can see whether the unit spent its life on paved highway runs or on gravel approaches where sidewall damage is common. A complete log is a genuine asset in a negotiation, and a gap in the log invites a lower offer.
Rates and Payment
Rates are agreed at the board bay and recorded on the ticket. The rate covers the posted service and does not include fuel surcharges, waiting time or detention unless these are written on the ticket at the time of booking.
Invoices are due within the period stated on the ticket. The company may charge interest on an overdue amount at a rate that is lawful in the province where the yard operates. Where an amount is disputed, the undisputed portion should be paid while the dispute is investigated.
All amounts are stated in Canadian dollars unless the ticket says otherwise. Bank charges and transfer fees are the responsibility of the carrier.
Waiting time is charged only where it is recorded on the ticket and where the delay is attributable to the mill or the supplier rather than to the carrier. A carrier that arrives late for a booked window does not earn waiting time, and a carrier that is held at the gate for a reason outside its control should ask the clerk to note the hold on the sheet before leaving.
Limitation of Liability
The company provides dispatch support in good faith and takes reasonable care in preparing tickets, sheets and weigh bills. The company does not control the road, the weather, the mill gate or the carrier vehicle, and it cannot promise that a run will proceed without interruption.
To the extent permitted by law, the company is not liable for indirect or consequential loss, including loss of profit, loss of contract, penalty from a customer or loss of goodwill arising from a delayed run or a refused load.
Where the company is found liable for a direct loss, its liability is limited to the fee charged for the specific service that gave rise to the loss. This limit does not apply where the law prohibits a limitation, including where the loss results from the companys own gross negligence or wilful misconduct.
Indemnity
A carrier agrees to indemnify the company against a claim, loss or expense that arises from the carriers breach of these terms, its unsafe operation of a vehicle, its failure to hold valid insurance, or its provision of false information at a desk.
Likewise, the company will indemnify a carrier against a direct loss caused by the companys own negligence in issuing a ticket, a sheet or a weigh bill, to the limit stated in the liability section.
Insurance
A carrier must hold commercial vehicle insurance that covers the loads it books and must provide evidence of cover on request. The company may ask for a certificate of insurance before issuing a ticket on an oversize move or on a first booking with a new carrier.
Lapse of insurance suspends the carriers right to use the yard until evidence of renewed cover is provided. The company does not insure a load on behalf of a carrier, and a carrier should not assume that yard possession of a bunk creates cover.
Use of the Website
A visitor may read the website, use the contact form and follow the published links. A visitor must not attempt to gain unauthorised access to any system, interfere with the operation of the site, submit false information through the form, or use the site to distribute unlawful material.
The website content is provided for information. It is not a quote, an offer of carriage or a guarantee of capacity. A binding booking exists only when a ticket number is issued at the yard.
The company may suspend or restrict access to the website where it detects abusive traffic or a security risk. A suspension of website access does not affect a ticket already issued at the yard.
Intellectual Property
The text, layout, stylesheets and scripts of the website belong to Tes Transportation Inc. or are used with permission. The developer TES Transport prepared the technical build and retains no right to reuse the content of the company in another project.
A visitor may print or save a page for personal reference and may quote a short passage with attribution. A visitor must not copy a substantial part of the site, mirror it on another domain or use the company name or marks in a way that suggests endorsement without written permission.
Privacy
The handling of personal information is described in the privacy policy, which forms part of these terms. A user should read the privacy policy before submitting the contact form or signing a driver sheet.
Where these terms are silent on the handling of personal information, the privacy policy applies. Where the two documents appear to conflict on a privacy question, the privacy policy governs that question.
Events Beyond Control
The company is not in breach of these terms where a delay or failure results from an event beyond its reasonable control. Such events include severe weather, a road closure ordered by an authority, a fire or flood at the yard, a labour disruption, a failure of the public power supply or a widespread outage of telecommunications.
Where such an event occurs, the company will notify affected carriers as soon as practical and will resume service when it is safe to do so. Either party may cancel a booking that cannot reasonably be performed because of the event, and amounts already paid for an unperformed service will be returned.
Suspension and Termination
The company may suspend or terminate a carriers access to the yard where the carrier breaches these terms, fails to pay an amount due, provides false information or acts in a way that endangers staff or other users of the deck.
Termination does not release a carrier from an amount already owed, and it does not release either party from an obligation that by its nature survives, including the indemnity and limitation sections.
Suspension is reviewed by the gate office rather than imposed by a single clerk. Where a carrier believes a suspension is mistaken, it should put the circumstances in writing and the office will re-examine the record. A review ordinarily takes a small number of working days, and the yard will not dispose of a disputed ticket file while the review is open.
Governing Law
These terms are governed by the laws of the province of Ontario and the federal laws of Canada that apply there. The courts of the province have exclusive jurisdiction over a dispute arising from these terms, unless the law requires a different forum.
Before starting a formal proceeding, the parties should attempt to resolve the dispute by written correspondence. A carrier should send a written summary of the dispute to note@testransport.hair or by post to 15 Algonquin Forest Dr, East Gwillimbury - L9N 0C6, Canada (CA). The company will respond in writing within a reasonable period.
Changes to These Terms
The company may update these terms when its services change or when the law requires a different statement. The updated version will be posted on this page with a new effective date.
A carrier that continues to book work after an update is treated as having accepted the updated terms. A carrier that does not accept an update may finish a ticket already issued under the terms that applied when the ticket was opened.
Contact Details
Questions about these terms should be sent to Tes Transportation Inc. at note@testransport.hair or by telephone at +13094556577. Written correspondence should be addressed to 15 Algonquin Forest Dr, East Gwillimbury - L9N 0C6, Canada (CA).
The gate office is open during yard hours and can answer a question about a live ticket. A question about a contract, a dispute or an insurance matter should be put in writing so that it can be recorded properly.
